  3. Customer Responsibilities & Data

    You are responsible for the data you provide and for ensuring you have appropriate rights, notices, and consent (if required) for collection, use, and disclosures. Where your data includes personal information and you collect it through your use of online tracking, you must comply with applicable privacy requirements, including Personal Information Protection and Electronic Documents Act.

  4. Subscriptions, Fees & Billing

    Fees are set forth at checkout or in your subscription plan. Unless stated otherwise, fees are non-refundable. We may change pricing with notice. Taxes may apply and will be added where required.

  5. Privacy, Tracking & Consent (Summary)

    If the Services involve collection, use, or disclosure of personal information (including personal information collected via online tracking where applicable), we process it in accordance with our privacy practices and require meaningful consent for those activities, consistent with Personal Information Protection and Electronic Documents Act. If there is a security breach triggering statutory thresholds, we will comply with mandatory breach notification and record-keeping requirements under Personal Information Protection and Electronic Documents Act, Breach of Security Safeguards Regulations.     The Services provide analytics and tools. We do not guarantee hiring outcomes, candidate acceptance, or any particular result.

  8. Disclaimers of Warranties

    The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

  9. Limitation of Liability

    To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our total liability for any claim related to the Services will not exceed the fees you paid to us in the 3 months preceding the event giving rise to the claim.

  10. Intellectual Property

    The Services and related materials are owned by us or our licensors and are protected by intellectual property laws. You receive a limited, revocable, non-transferable license to access the Services for your internal business purposes.

  11. Marketing & Claims (Truthfulness)

    You agree not to make materially false or misleading claims about the Services or business interest in your marketing materials. We also take steps to ensure our promotional materials are not materially false or misleading, consistent with Competition Act.

  12. Termination

    We may suspend or terminate access if you materially violate these Terms or for legal/safety reasons. You may stop using the Services at any time. Any fees paid are subject to the subscription terms.

    We may update these Terms from time to time. The updated Terms will be posted on this page with a new “Last updated” date. Continued use after changes means you accept the updated Terms.

  14. Governing Law

    These Terms are governed by the laws of Canada and, where applicable, the province of Ontario, without regard to conflict of law principles.
